Terms of Service

リアライズワークス株式会社 (hereinafter referred to as “the Company”) establishes the following Terms of Service governing the use of “GARDEN TOKYO” (hereinafter referred to as “the Service”), which the Company operates. Use of the Service is conditional upon acceptance of all provisions of these Terms. Please read these Terms carefully before registering.

Article 1. Scope and amendments to these Terms

These Terms apply to the use of the Service between members (as defined in Article 2, Paragraph 1) and the Company, and must be observed during the registration process and after registration.

The Company may add or amend provisions to these Terms without obtaining members’ prior consent by posting them on the site, notifying members by email, or using another method the Company considers appropriate.

If these Terms are amended, members will be bound only by the amended Terms.

Article 2. Membership registration

A “member” means an individual who has approved all provisions of these Terms, applied for membership in accordance with the procedures prescribed by the Company, and whose application has been approved by the Company.

A person wishing to register as a member must complete the registration process themselves through the membership registration page of the Service in accordance with the method specified by the Company. Registration by a representative is not permitted.

The Company may refuse an application for membership, or cancel an existing registration without prior notice, if the applicant falls under any of the following circumstances.

  • It is discovered that the applicant has been subject to measures such as cancellation of membership registration for violating the terms of any service provided by the Company

  • The membership application contains false information

  • The applicant has delayed or otherwise failed to fulfill payment obligations, including charges for products or services (hereinafter referred to as “Products and Services”)

  • The applicant has engaged in conduct prohibited under Article 6 (Prohibited Conduct) of these Terms

  • The applicant has otherwise violated these Terms

Article 3. Changes to registration information

If any of the registered information changes, in whole or in part, the member must immediately update it using a method separately specified by the Company. If the member fails to make such an update, any processing based on the information already registered will be deemed proper and valid.

The Company assumes no responsibility for any damage arising from failure to update the registration information.

Article 4 Management of Accounts and Authentication Information

Members shall appropriately manage the information used to log in to the Service, including their registered email address and login authentication codes.

Members shall not transfer, lend, disclose, or allow the leakage of their account or authentication information to any third party.

If you suspect unauthorized use, please contact us promptly. Our liability shall be governed by applicable laws and regulations, and nothing in this provision limits consumer rights recognized by law.

Article 5. Withdrawal from membership

If a member wishes to close their membership account, they must request this through the chat on this site or by email. Membership will be terminated upon completion of the identity verification and withdrawal procedures prescribed by us. Transaction information and other records that must be retained by law may be kept for the legally prescribed period.

Article 6. Prohibited Conduct

When using the Service, members must not engage in any of the following conduct.

  • Conduct that violates these Terms or laws and regulations, is connected with a crime, violates public order or morals, or may do any of the foregoing

  • Entering false information or another person’s information when registering as a member or changing registration information

  • Conduct that interferes with the operation of the Service or may otherwise disrupt the Service

  • Conduct that infringes or may infringe the property, privacy, copyrights or other intellectual property rights, or other rights of other members, third parties, or the Company

  • Conduct that defames or slanders other members, third parties, or the Company, or damages or may damage their reputation

  • Conduct that causes or may cause inconvenience, disadvantage, or damage to other members, third parties, or the Company

  • Unauthorized use of a user ID or password

  • Purchases for commercial purposes, such as resale by businesses in the same industry

Article 7. Copyrights, trademark rights, and other intellectual property rights

All copyrights, trademark rights, and other intellectual property rights in any content provided through the Service, including text, illustrations, designs, photographs, images, logos, icons, videos, and programs (hereinafter referred to as “Content”), belong to the Company. Members and users must not engage in conduct that infringes these rights.

Regardless of purpose, any unauthorized use of all or part of the Content or other material posted on the Service—including reproduction, modification, adaptation, transfer, transmission, distribution, posting, sale, and publication—is strictly prohibited.

If a problem arises with a third party due to a violation of this Article, the member must resolve the problem at their own responsibility and expense and must not cause the Company any damage, loss, or disadvantage.

Article 8. Purchase of products

Members may purchase Products and Services from the Company by using the Service.

When purchasing Products and Services, members must submit an application to purchase in accordance with the method specified by the Company.

A sales contract for the relevant Products and Services is formed between the member and the Company when the Company completes processing the application referred to in the preceding paragraph and an email notifying the member that the product has been shipped is sent by the Company.

Notwithstanding the preceding paragraph, even after a sales contract for the relevant Products and Services has been formed, if it is discovered that the member engaged in fraudulent or inappropriate conduct in connection with use of the Service, or circumstances strongly suggesting such conduct are found, the Company may, at its discretion, cancel or terminate the sales contract or take other appropriate measures. The same applies if it is discovered that the price or other sales conditions for Products and Services displayed by the Company on the Service contained an obvious typographical error.

Applications to purchase must be made by the member themselves. Even if a third party purchases Products and Services as the member’s representative or by borrowing the member’s name, the member bears all rights and obligations arising from the purchase.

Products may be shipped only to addresses within Japan and to countries or regions to which delivery is available.

Article 9. Payment methods

The amount payable for Products and Services is the total of the product price, shipping fees, and applicable taxes and charges. Please check the checkout screen and the Notation under the Act on Specified Commercial Transactions for the conditions under which shipping fees, taxes, and charges apply.

You may pay using the methods displayed at checkout, including credit cards, Shop Pay, PayPal, Apple Pay, and Google Pay. Available payment methods vary depending on the destination, currency, device, and other factors.

Cash on delivery is available only for deliveries within Japan. The cash-on-delivery fee is JPY 450 (tax included). Please pay the order total shown at checkout plus the cash-on-delivery fee in cash to the delivery company. Cash on delivery is not available for overseas deliveries.

For credit card payments, members are subject to the terms of their separate agreement with the credit card company. If a dispute arises between a member and a credit card company or other third party, the parties concerned must resolve it between themselves, and the Company assumes no responsibility.

Article 10. Product returns and exchanges

Product returns and exchanges are handled in accordance with the Company’s Refund Policy. For ordinary returns or exchanges, please contact us within 7 days after delivery within Japan or within 14 days after delivery outside Japan.

For deliveries within Japan, the Company covers the shipping costs for returns or exchanges of eligible products. For overseas deliveries, the customer is responsible for tracked return shipping for returns or exchanges due to customer preference. The Company covers the shipping costs for resending replacement items overseas and any customs duties and import taxes incurred when resending them.

For standard returns and exchanges, we accept requests only if you contact us via chat on this site or by email before sending the item back. Please provide your order number and the details of your inquiry. After reviewing your request, we will provide the return address and instructions. Please do not send the item back before receiving our instructions. This does not limit any consumer rights under applicable law.

For defective products or incorrect deliveries, the Company will arrange return shipping and an exchange or refund at its expense. If a replacement is not in stock, the Company will issue a refund.

Consumer rights recognized under the laws of the destination, including statutory withdrawal rights in the EU and UK, are not restricted by this Article or the Company’s guidance. The Refund Policy and applicable laws and regulations take precedence with respect to request periods, eligible products, costs, and refund details.

Article 11. Disclaimer regarding Products and Services

Unless expressly stated otherwise, any warranty for Products and Services sold through the Service is governed by the terms of the product warranty provided with them.

Although the Company strives to ensure the accuracy of product images displayed on the Service, colors, sizes, and other features may differ slightly from the actual products due to screen settings and photographic techniques.

Except as specified in Paragraph 1 of this Article, the Company makes no warranties and assumes no responsibility for the quality, performance, compatibility with other products, or other defects of Products and Services sold through the Service, or for any damage, loss, or disadvantage caused by them.

After the Company hands products over to a contracted delivery company and requests delivery to the shipping address registered by a member, the Company assumes no responsibility for any problems arising thereafter, such as an unknown delivery address.

Article 12. Information management

The Company will use the member information it obtains for the purposes listed below. The Company may also entrust work to contractors selected by the Company to achieve those purposes.

  • Management of members and users of the Service

  • Issuing email newsletters

  • Providing services such as points programs

  • Introducing, advertising, promoting, and soliciting sales of the Company’s Products and Services

  • Shipping products

  • Customer support

  • Planning campaigns and other initiatives, and conducting surveys

  • Providing other content related to the Service

  • Marketing activities after processing information so that individuals cannot be identified

As a general rule, the Company will not disclose or provide member information disclosed by a member during membership registration or subsequent changes to member information to a third party without the member’s prior consent. However, the Company may disclose or provide such member information without the member’s prior consent in the following cases.

  • When information has been processed into statistical data in a form that does not identify members

  • When disclosure or provision of member information is requested under laws and regulations or similar requirements

If the Company determines it necessary, the Company may delete or change the location of comments or other information posted by a member after the member has consented to its use by the Company, without notifying the member, when the information is found to clearly damage the reputation or credit of another member, a third party, or the Company, or to violate laws and regulations, among other reasons.

In addition to the preceding 3 paragraphs, the Company will handle member information it obtains in accordance with the separately established “Handling of Personal Information.”

Article 13. Use of the Service

When using the Service, you must first agree to these Terms and the separately established “Handling of Personal Information.”

Article 14. Changes to or discontinuation of the Service

We may temporarily suspend all or part of this service if any of the following applies:

  • When an urgent maintenance inspection is required due to a problem with the computer system used to provide the Service (hereinafter referred to as the “System”)

  • When operation of the System becomes difficult due to a fire, power outage, natural disaster, or other force majeure

  • When operation of the System becomes difficult due to a human-caused disaster (war, riot, civil disturbance, labor dispute, etc.)

  • When operation of the System becomes difficult due to interference by a third party or similar conduct

  • When the Company determines that it is otherwise unavoidable to suspend the System

Article 15. Other disclaimers

The Company is exempt from liability for any damage to a member resulting from the Company processing matters in accordance with the user’s registered information.

The Company assumes no responsibility for damage to a member resulting from interruption, delay, or suspension of the System due to a failure in communication lines, computers, or similar systems, or from alteration of a webpage, despite the Company having taken reasonable safety measures.

The Company does not guarantee that emails or content sent from the Company’s webpages, servers, domains, or similar sources are free of harmful content, such as computer viruses.

The Company may provide information or advice to members from time to time, but shall not thereby incur any liability.

The Company assumes no responsibility whatsoever for damage or similar consequences arising from a member’s violation of these Terms.

Article 16. Miscellaneous

If a problem arises in connection with use of the Service that cannot be resolved through these Terms or the Company’s guidance or response, the Company and the user will discuss the matter in good faith and resolve it.

If litigation becomes necessary in connection with use of the Service, the Tokyo District Court will have exclusive agreed jurisdiction as the court of first instance.

Nothing in these Terms limits consumer rights granted under applicable law. If any provision concerning disclaimers, changes to the agreement, governing law, jurisdiction, or any other matter conflicts with a mandatory provision of applicable law, that law will prevail.

Supplementary provision: These Terms apply to all users from 2023/11/25.
